Koan is operated by Prism Intelligence Inc. This Privacy Policy explains what personal information we collect, how we use it, how we share it, and the choices and rights you may have.

1. Personal Information We Collect

1.1 Information You Provide

We may collect personal information you provide directly, including your name, email address, account credentials, billing details, subscription information, support messages, settings, watchlists, saved preferences, and any content or information you choose to submit through Koan.

1.2 Payment Information

Payments may be processed by third-party payment providers. We may receive limited billing information, such as payment status, billing contact details, plan type, invoice history, and partial payment card details. We do not intend to store full payment card numbers.

1.3 Usage, Device, and Log Information

When you use Koan, we may collect technical and usage information such as IP address, browser type, device type, operating system, referring pages, pages viewed, features used, session activity, error logs, timestamps, and approximate location derived from IP address.

1.4 Cookies and Similar Technologies

We use cookies, pixels, local storage, and similar technologies to operate Koan, keep users signed in, remember preferences, understand usage, improve performance, measure marketing, and, where used, support advertising.

3. Legal Bases for EEA, UK, and Swiss Users

If you are in the European Economic Area, United Kingdom, or Switzerland, we process personal information under one or more of the following legal bases:

  • performance of a contract, when processing is needed to provide Koan;
  • legitimate interests, such as security, analytics, fraud prevention, service improvement, and business operations;
  • consent, such as for certain cookies, marketing, or advertising where required; and
  • legal obligation, when processing is needed to comply with applicable law.

4. How We Share Personal Information

We may share personal information with:

  • service providers that help us operate Koan, such as hosting, analytics, payment processing, customer support, email delivery, logging, security, and infrastructure providers;
  • advertising and measurement partners, where used, for campaign measurement, attribution, and targeted advertising;
  • professional advisers, such as lawyers, accountants, auditors, and insurers;
  • authorities, regulators, courts, or other parties when required by law or when necessary to protect rights, safety, users, or the public;
  • parties involved in a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets; and
  • other parties with your consent or at your direction.

We do not sell personal information for money. If we use advertising or measurement partners in a way that qualifies as a sale, sharing, or targeted advertising under applicable privacy laws, you may opt out as described below.

5. California Privacy Notice

This section applies to California residents where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies.

We do not knowingly sell or share personal information of users under 16.

5.3 California Rights

California residents may have the right to request access, correction, deletion, portability, and information about how personal information is collected, used, disclosed, sold, or shared. California residents may also have the right to opt out of sale or sharing and the right not to be discriminated against for exercising privacy rights.

Where legally required, Koan will honor recognized opt-out preference signals, such as Global Privacy Control, for the browser or device that sends the signal.

6. EEA, UK, and Swiss Privacy Rights

Depending on your location, you may have the right to request access, correction, deletion, restriction, portability, or objection to certain processing. Where processing is based on consent, you may withdraw consent at any time.

7. Marketing Choices

You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us at [email protected]. You may still receive service-related messages such as account, billing, security, and legal notices.

8. Data Retention

We retain personal information for as long as needed to provide Koan, maintain accounts, comply with legal obligations, resolve disputes, enforce agreements, protect security, and maintain business records. We may retain aggregated or de-identified information for longer periods.

9. Security

We use reasonable technical and organizational measures designed to protect personal information. These may include HTTPS, access controls, logging, monitoring, and vendor security controls. No system is completely secure, and we cannot guarantee absolute security.

10. International Transfers

Koan is based in the United States, and personal information may be processed in the United States and other countries. Where required, we rely on appropriate transfer mechanisms, such as Standard Contractual Clauses, for transfers from the EEA, UK, or Switzerland.

11. Children

Koan is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to Koan, contact us at [email protected].

12. Third-Party Links and Services

Koan may link to or integrate with third-party websites, products, APIs, or services. Their privacy practices are governed by their own policies, not this Privacy Policy.
